Stra­tegic context

  1. An up to date set of Stand­ing Orders, set­ting out the oper­a­tion of the Park Authority’s board and com­mit­tee meet­ings, is a key ele­ment of our gov­ernance framework.

Pur­pose

  1. This paper presents an update to the Park Authority’s Stand­ing Orders, which were last reviewed in 2019.

Recom­mend­a­tions

  1. The Board Is asked to: a) Con­sider pro­posed changes to the Park Author­ity board’s Stand­ing Orders b) Agree stand­ing orders.

Stra­tegic policy consideration

  1. A num­ber of inter­im amend­ments have been agreed by the board to the Park Authority’s Stand­ing orders to accom­mod­ate new ways of work­ing and adapt­a­tions to tech­no­lo­gic­al devel­op­ments. This update con­sol­id­ates those amendments.

  2. The Park Authority’s Code of Con­duct has also been sig­ni­fic­antly revised, fol­low­ing the Stand­ards Com­mis­sion for Scotland’s new mod­el Code for Non-Depart­ment­al Pub­lic Bod­ies. The update presen­ted also rein­forces the inter­ac­tion between the Code and the board’s oper­a­tions as set out in Stand­ing Orders.

Stake­hold­er engagement

  1. The Frame­work agree­ment between the Park Author­ity and Scot­tish Gov­ern­ment requires that the board ensures that effect­ive gov­ernance is estab­lished and main­tained, includ­ing ensur­ing that decision-tak­ing is open and trans­par­ent (sec­tion

11c). Ensur­ing stand­ing orders are up to date, clear and cov­er all require­ments in sup­port of con­duct­ing the Park Authority’s busi­ness rep­res­ents a key aspect of ful­filling this requirement.

  1. The update to Stand­ing Orders mit­ig­ates the risk of suc­cess­ful leg­al chal­lenge to any decision of the Park Author­ity on a pro­ced­ur­al basis.
