Dear Mr Harris,
Town and Country Planning (Scotland) Act 1997 Notice of Intention to Adopt – Cairngorms National Park Authority Local Development Plan 2020
I refer to your correspondence of 24 November 2020 certifying notice of Cairngorms National Park Authority’s intention to adopt the Cairngorms National Park Authority Local Development Plan 2020.
Scottish Ministers have decided that the proposed plan as notified is unsatisfactory and hereby direct under section 20(5) of the Town and Country Planning (Scotland) Act 1997, that Cairngorms National Park Authority consider modifying the proposed Cairngorms National Park Authority Local Development Plan 2020 as indicated in the Annex to this direction.
This direction is considered necessary because it is important that users of the plan are directed towards up to date information, including routing, regarding the dualling of the A9 carriageway within the Cairngorms National Park area. The A9 dualling between Perth and Inverness is one of Scotland’s largest transport infrastructure programmes and will have transport implications for specific settlements in the Cairngorms area.
Section 20(6) provides (subject to any further direction under section 20) that your authority may not adopt the Cairngorms National Park Authority Local Development Plan 2020 unless you satisfy Scottish Ministers that you have made the modifications necessary to conform with this direction, or the Scottish Ministers withdraw it.
I would be grateful if you would therefore confirm that your authority will modify the plan.
