Sec­tion 4ZB(2)	In exer­cising their func­tions of pre­par­ing, revis­ing or amend­ing a loc­al devel­op­ment plan, a plan­ning author­ity must have regard to their adop­ted region­al spa­tial strategy and any loc­al hous­ing strategy.
Sec­tion 264A	In the exer­cise, with respect to any land in a Nation­al Park, of any power under the plan­ning Acts, spe­cial atten­tion shall be paid to the desirab­il­ity of exer­cising the power con­sist­ently with the adop­ted Nation­al Park Plan.

Policy con­text

Nation­al Park (Scot­land) Act 2000 The Nation­al Park has four dis­tinct aims as set out in The Nation­al Parks (Scot­land) Act 2000). The fourth aim is ​‘to pro­mote sus­tain­able eco­nom­ic and social devel­op­ment of the area’s com­munit­ies’. The aims are all to be pur­sued col­lect­ively. How­ever, if there is con­flict between the first aim and any of the oth­ers, great­er weight is giv­en to the first aim (as set out in Sec­tion 9(6) of the 2000 Act).

Crofters (Scot­land) Act 1993 The Crofters (Scot­land) Act 1993, as amended by the Croft­ing Reform etc Act 2007, Croft­ing Reform (Scot­land) Act 2010, and Croft­ing (Amend­ment) (Scot­land) Act 2013, forms the legis­lat­ive frame­work that gov­erns the use of croft land in Scot­land. The act sets out the defin­i­tion for crofts and crofters and sets out duties crofters must meet to occupy croft land, includ­ing duties relat­ing to res­id­ency, main­ten­ance, cul­tiv­a­tion and use. Nation­al Plan­ning Frame­work 4 Policy 17 states that loc­al devel­op­ment plans should set out pro­vi­sion for tailored approaches to rur­al hous­ing, includ­ing pro­vi­sion for small-scale hous­ing such as crofts or wood­land crofts.

Scotland’s Hous­ing Emer­gency The Scot­tish par­lia­ment declared a hous­ing emer­gency on 15 May 2024. As well as identi­fy­ing the reas­on­ing for why there is a hous­ing emer­gency in Scot­land and the fact that nearly £600 mil­lion will be inves­ted in afford­able hous­ing by the Scot­tish Gov­ern­ment in 2024 – 25, the declar­a­tion agreed that the Scot­tish Gov­ern­ment, UK Gov­ern­ment and loc­al author­it­ies must work togeth­er to deliv­er a hous­ing sys­tem that meets the needs of the people of Scot­land. The First Min­is­ter con­firmed his inten­tion to engage con­struct­ively to expand hous­ing sup­ply and tackle homelessness.
