Representation – objection
RE: Application Number 24/04130/MSC
Dear Sir/Madam;
Thank you for ‘Notification’ of the Planning Application 24/04130/MSC.
With reference to the above application, we would like to inform you of our objection and further points of consideration, alongside our previous letter of 25.4.21 and 14.1.24
Access and Right of Ways. The established path and ‘Right of Way’ along the boundary fence of The Snipe has now been removed in the recent plans (PathA). We are therefore, extremely concerned and object this path has been removed. Removing firstly, a buffer between the new houses and The Snipe, secondly the houses are closer reducing privacy and thirdly, there is no identified access to this Right of Way from our back gate to amenities for us and our neighbour at No.2. Also, we ask if plans go ahead this path is retained, so it provides the appropriate separation between properties for maintenance of a long border fence. We have had access to this path since we have lived here over 23years.
Water Management With reference to the HGA Consultancy Engineers Report, the Drainage Impact Assessment states (P4 2.0), “Any surface water runoff will discharge from this site by infiltration and onto the adjoining land”. We have major concerns and objections to this risk. This water run off will have a negative impact on The Snipe. The soil survey was carried out on 19.02.2020 noted and carried out with ‘snow at ground level’, indicating that this survey was carried out when the ground was frozen. We would appreciate clarification regarding this or is there a need to carry out a test at a different time of year and location e.g. at the lowest point of the site. The 3 test sites on the plans appear quite far from the lowest point of the site. There is a strong possibility that the new development could concentrate the runoff along this lowest point between the properties causing water logging in the garden. We would like to seek reassurance that this has been taken into account in the design going forward. We would like complete reassurance that the development will not be a negative impact and any future issues will be their responsibility to address and no cost to the adjacent properties (The Snipe).
Please refer to our previous correspondence 25.4.21 and 14.1.24 and if you could address our concerns regarding the impact on wildlife, trees, Bat Survey, this would be appreciated as we did not hear a response.
Thank you, we look forward to our points being addressed and your reply. We appreciate the need for housing in rural locations but have grave concerns about this development and the negative impact it will have on my property. As previously suggested, we would welcome a site visit to support clarification of our points.

Thank you for your letter 22/12/23 in regards to the proposal of the ‘Erection of 4 Houses’ at the South of The Snipe. We have afew concerns and objections to this proposal. We feel this proposal has a great impact on our property, privacy and anxieties.
We would greatly appreciate it, if you could consider and confirm a number of concerns not clearly for us addressed in the plans:
Flood risk to our garden and property is of particular worry. The ‘run off’is explained as being dealt with through infiltration, however the increased discharge is not being dealt with, as there is no additional interventions to prevention flooding as indicated by SEPA, that would stop flooding risk from higher ground from surface run off. Any run off will run into our garden. Has this been considered?
We had enjoyed the established access from our back gardens onto the Right of Way and have used the foot paths for over 20 years. Could you please confirm this will remain unhindered? Also the diagonal path that goes directly up from our back gate? This does not seem clear from the plans.
The very close proximity of the houses will have a great impact on our privacy. This includes when in the garden and being overlooked while in the house. We feel these houses will particularly block light? The elevated position of this new development will impact on our personal space and vice versa, as houses No.1 and No.2 are built directly behind. Could you consider building these 2 houses further left so we are not 100% overlooked. Look forward to hearing your thoughts and considerations as this is causing anxiety for us.
Concerns that the development has a greater loss of big trees, completely impacting on the landscape, wildlife and natural woodland. Could you confirm that a Bat Survey has been carried out. We regularly encounter bat’s and believe they are roosting in the trees.
