RE: Applic­a­tion Num­ber 24/04130/MSC

Dear Sir/​Madam;

Thank you for Noti­fic­a­tion’ of the Plan­ning Applic­a­tion 24/04130/MSC.

With ref­er­ence to the above applic­a­tion, we would like to inform you of our objec­tion and fur­ther points of con­sid­er­a­tion, along­side our pre­vi­ous let­ter of 25.4.21 and 14.1.24

  1. Access and Right of Ways. The estab­lished path and Right of Way’ along the bound­ary fence of The Snipe has now been removed in the recent plans (PathA). We are there­fore, extremely con­cerned and object this path has been removed. Remov­ing firstly, a buf­fer between the new houses and The Snipe, secondly the houses are closer redu­cing pri­vacy and thirdly, there is no iden­ti­fied access to this Right of Way from our back gate to amen­it­ies for us and our neigh­bour at No.2. Also, we ask if plans go ahead this path is retained, so it provides the appro­pri­ate sep­ar­a­tion between prop­er­ties for main­ten­ance of a long bor­der fence. We have had access to this path since we have lived here over 23years.

  2. Water Man­age­ment With ref­er­ence to the HGA Con­sultancy Engin­eers Report, the Drain­age Impact Assess­ment states (P4 2.0), Any sur­face water run­off will dis­charge from this site by infilt­ra­tion and onto the adjoin­ing land”. We have major con­cerns and objec­tions to this risk. This water run off will have a neg­at­ive impact on The Snipe. The soil sur­vey was car­ried out on 19.02.2020 noted and car­ried out with snow at ground level’, indic­at­ing that this sur­vey was car­ried out when the ground was frozen. We would appre­ci­ate cla­ri­fic­a­tion regard­ing this or is there a need to carry out a test at a dif­fer­ent time of year and loc­a­tion e.g. at the low­est point of the site. The 3 test sites on the plans appear quite far from the low­est point of the site. There is a strong pos­sib­il­ity that the new devel­op­ment could con­cen­trate the run­off along this low­est point between the prop­er­ties caus­ing water log­ging in the garden. We would like to seek reas­sur­ance that this has been taken into account in the design going for­ward. We would like com­plete reas­sur­ance that the devel­op­ment will not be a neg­at­ive impact and any future issues will be their respons­ib­il­ity to address and no cost to the adja­cent prop­er­ties (The Snipe).

  3. Please refer to our pre­vi­ous cor­res­pond­ence 25.4.21 and 14.1.24 and if you could address our con­cerns regard­ing the impact on wild­life, trees, Bat Sur­vey, this would be appre­ci­ated as we did not hear a response.

Thank you, we look for­ward to our points being addressed and your reply. We appre­ci­ate the need for hous­ing in rur­al loc­a­tions but have grave con­cerns about this devel­op­ment and the neg­at­ive impact it will have on my prop­erty. As pre­vi­ously sug­ges­ted, we would wel­come a site vis­it to sup­port cla­ri­fic­a­tion of our points.

Thank you for your let­ter 22/12/23 in regards to the pro­pos­al of the Erec­tion of 4 Houses’ at the South of The Snipe. We have afew con­cerns and objec­tions to this pro­pos­al. We feel this pro­pos­al has a great impact on our prop­erty, pri­vacy and anxieties.

We would greatly appre­ci­ate it, if you could con­sider and con­firm a num­ber of con­cerns not clearly for us addressed in the plans:

  1. Flood risk to our garden and prop­erty is of par­tic­u­lar worry. The run off’is explained as being dealt with through infilt­ra­tion, how­ever the increased dis­charge is not being dealt with, as there is no addi­tion­al inter­ven­tions to pre­ven­tion flood­ing as indic­ated by SEPA, that would stop flood­ing risk from high­er ground from sur­face run off. Any run off will run into our garden. Has this been considered?

  2. We had enjoyed the estab­lished access from our back gar­dens onto the Right of Way and have used the foot paths for over 20 years. Could you please con­firm this will remain unhindered? Also the diag­on­al path that goes dir­ectly up from our back gate? This does not seem clear from the plans.

  3. The very close prox­im­ity of the houses will have a great impact on our pri­vacy. This includes when in the garden and being over­looked while in the house. We feel these houses will par­tic­u­larly block light? The elev­ated pos­i­tion of this new devel­op­ment will impact on our per­son­al space and vice versa, as houses No.1 and No.2 are built dir­ectly behind. Could you con­sider build­ing these 2 houses fur­ther left so we are not 100% over­looked. Look for­ward to hear­ing your thoughts and con­sid­er­a­tions as this is caus­ing anxi­ety for us.

  4. Con­cerns that the devel­op­ment has a great­er loss of big trees, com­pletely impact­ing on the land­scape, wild­life and nat­ur­al wood­land. Could you con­firm that a Bat Sur­vey has been car­ried out. We reg­u­larly encounter bat’s and believe they are roost­ing in the trees.
