Title: DEVEL­OP­MENT PLAN SCHEME 2022

Pur­pose of Report

To present to the Plan­ning Com­mit­tee the Devel­op­ment Plan Scheme (2022) that sets out the times­cales for the deliv­ery of the next LDP.

Back­ground

  1. All plan­ning author­it­ies in Scot­land are required to pro­duce an annu­ally updated Devel­op­ment Plan Scheme (DPS) to set out how they are pro­gress­ing work to adopt and review their Loc­al Devel­op­ment Plan (LDP). The DPS is required to out­line a timetable for the key steps in pro­du­cing the LDP. It also includes a par­ti­cip­a­tion state­ment’, which explains how and when loc­al res­id­ents and oth­er inter­ested groups can become engaged in the pro­duc­tion of the LDP.

Devel­op­ment Plan Scheme 2022

  1. The cur­rent LDP for the Cairngorms Nation­al Park was adop­ted on 26 March 2021 and, in accord­ance with cur­rent plan­ning legis­la­tion, lasts for a peri­od of five years. We must there­fore work towards hav­ing a new LDP (LDP3) in place by April 2026.

  2. The pro­posed DPS for 2022 (attached at Appendix 1) sets out the timetable for pre­par­ing LDP3 and explains the key stages of pub­lic involve­ment in the process.

  3. LDP3 will be pro­duced in accord­ance with the new Plan­ning (Scot­land) Act 2019 which has brought sig­ni­fic­ant changes to the to the way LDPs are pro­duced. How­ever, sup­port­ing legis­la­tion for the full imple­ment­a­tion of the changes out­lined in the 2019 Act are yet to be released and there­fore there remain uncer­tain­ties about the times­cales and resource require­ments asso­ci­ated with pro­du­cing the new Plan.

  4. The cur­rent focus of the Nation­al Park Author­ity is the adop­tion of the next Nation­al Park Part­ner­ship Plan (NPPP). Upon it adop­tion the focus will shift to the pre­par­a­tion of the Loc­al Devel­op­ment Plan 2026. It is hoped that the expec­ted start date for the

LDP3 will coin­cide with the expec­ted deliv­ery of the new reg­u­la­tions to sup­port the 2019 Act.

Next Steps

  1. The DPS for 2022 will be pub­lished and sent to inter­ested parties in accord­ance with legis­lat­ive require­ments. The DPS will be reviewed and if neces­sary updated in 2023.
