Title: Scot­tish Gov­ern­ment Plan­ning Consultations

Pur­pose

  1. To update the com­mit­tee on three cur­rent Scot­tish Gov­ern­ment Plan­ning Consultations.

The Con­sulta­tions

  1. The Scot­tish Gov­ern­ment is cur­rently con­sult­ing on sec­ond­ary legis­la­tion (plan­ning reg­u­la­tions) related to the imple­ment­a­tion of the Plan­ning (Scot­land) Act 2019 through the abil­ity to amend devel­op­ment plans (NPF4 and LDPs) and to estab­lish Mas­ter­plan Con­sent Areas, and a wider con­sulta­tion in rela­tion resourcing the plan­ning sys­tem in Scot­land.   1. The Devel­op­ment Plan Amend­ment Reg­u­la­tions pro­posed allow Min­is­ters and plan­ning author­it­ies to make amend­ments to NPF4 and LDPs. Officers are not pro­pos­ing any sig­ni­fic­ant response from the CNPA on the reg­u­la­tions but do intend to high­light that Nation­al Park Part­ner­ship Plans should be referred to as plans that must be taken account of in amend­ing a devel­op­ment plan (as they are referred to in the guid­ance pre­pared by Scot­tish Gov­ern­ment to advise on the pre­par­a­tion of LDPs).

  2. The Mas­ter­plan Con­sent Area Reg­u­la­tions pro­posed set out the require­ments for the estab­lish­ment of Mas­ter­plan Con­sent Areas. It is not imme­di­ately clear that a Mas­ter­plan Con­sent Area will be a tool that would be used in the Cairngorms Nation­al Park, as typ­ic­ally they might be expec­ted to have great­er value in large devel­op­ment sites that we have few of. Officers do not pro­pose any form­al response from the CNPA on those regulations.

  3. The con­sulta­tion on the resourcing of the plan­ning sys­tem is wide-ran­ging. Parts of the con­sulta­tion relate to plan­ning fees that full plan­ning author­it­ies are best placed to advise on while oth­er ele­ments relate to a much wider range of issues includ­ing the plan­ning pro­fes­sion, train­ing of plan­ners and plan­ning staff, and train­ing (includ­ing man­dat­ory train­ing) of plan­ning com­mit­tee mem­bers. Officers are involved in feed­ing back through Heads of Plan­ning Scot­land (HoPS) on many of the oper­a­tion­al and pro­fes­sion­al ele­ments of the con­sulta­tion and don’t pro­pose a form­al response from the Plan­ning Com­mit­tee. We will update the Plan­ning Com­mit­tee on any future pro­pos­als that will affect the plan­ning sys­tem or the CNPA plan­ning service.
