Title: Scottish Government Planning Consultations

Purpose
- To update the committee on three current Scottish Government Planning Consultations.
The Consultations
- The Scottish Government is currently consulting on secondary legislation (planning regulations) related to the implementation of the Planning (Scotland) Act 2019 through the ability to amend development plans (NPF4 and LDPs) and to establish Masterplan Consent Areas, and a wider consultation in relation resourcing the planning system in Scotland. The Development Plan Amendment Regulations proposed allow Ministers and planning authorities to make amendments to NPF4 and LDPs. Officers are not proposing any significant response from the CNPA on the regulations but do intend to highlight that National Park Partnership Plans should be referred to as plans that must be taken account of in amending a development plan (as they are referred to in the guidance prepared by Scottish Government to advise on the preparation of LDPs).
The Masterplan Consent Area Regulations proposed set out the requirements for the establishment of Masterplan Consent Areas. It is not immediately clear that a Masterplan Consent Area will be a tool that would be used in the Cairngorms National Park, as typically they might be expected to have greater value in large development sites that we have few of. Officers do not propose any formal response from the CNPA on those regulations.
The consultation on the resourcing of the planning system is wide-ranging. Parts of the consultation relate to planning fees that full planning authorities are best placed to advise on while other elements relate to a much wider range of issues including the planning profession, training of planners and planning staff, and training (including mandatory training) of planning committee members. Officers are involved in feeding back through Heads of Planning Scotland (HoPS) on many of the operational and professional elements of the consultation and don’t propose a formal response from the Planning Committee. We will update the Planning Committee on any future proposals that will affect the planning system or the CNPA planning service.
