Annex I: Addi­tion­al bid information

Con­fid­en­ti­al­ity

The Park Author­ity has taken reas­on­able care to ensure that the inform­a­tion con­tained in this brief is true and accur­ate in all mater­i­al aspects. How­ever, the Park Author­ity does not accept any respons­ib­il­ity for the inform­a­tion con­tained herein or in any oth­er doc­u­ment or its accur­acy or com­plete­ness and shall not be liable for any loss or dam­age because of such inform­a­tion or any sub­sequent com­mu­nic­a­tion. For the avoid­ance of doubt, this exclu­sion extends to liab­il­ity in rela­tion to any state­ment, opin­ion or con­clu­sion con­tained in, or any omis­sion from, this brief (includ­ing its annex) and in respect of any oth­er writ­ten or oral com­mu­nic­a­tion trans­mit­ted (or oth­er­wise made avail­able) to any bid­der. Only the express terms of any writ­ten con­tract, as and when it is executed, shall have any con­trac­tu­al effect in con­nec­tion with those mat­ters to which this brief relates.

If you con­sider that any of the inform­a­tion included in your bid is com­mer­cially sens­it­ive, please mark this as ​‘CON­FID­EN­TIAL’ and explain in broad terms the harm that might res­ult from disclosure.

Com­ple­tion of quote

It should be noted that the Park Author­ity shall not be liable for any costs or expenses incurred with the pre­par­a­tion and/​or sub­mis­sion of your bid.

By sub­mit­ting a bid, bid­ders con­firm that all prices will remain val­id for 90 days from the bid sub­mis­sion deadline.

Evaluation/​Acceptance of Bid

The con­tract shall be awar­ded to the best bids to meet the Park Authority’s require­ments whilst hav­ing regard to price. The Park Author­ity shall not be bound to accept the low­est or any bid.

Bids will only be accep­ted by issue of a let­ter of accept­ance by the Park Author­ity fol­low­ing the bid process.

Error

Bid­ders are advised that if the Park Author­ity sus­pects that there has been an error in the price cal­cu­la­tion in a bid (or if bid­ders sub­mit a price that is sig­ni­fic­antly and unreal­ist­ic­ally low) it reserves the right to seek cla­ri­fic­a­tion as it con­siders neces­sary from the bid­der. In rela­tion to sig­ni­fic­antly low and unreal­ist­ic prices sub­mit­ted, bid­ders may be asked to con­firm the accur­acy and abil­ity to sus­tain such a price. The Park Author­ity reserves dis­cre­tion to reject any bid return whereby an abnor­mally low price can­not be justified.

Con­tract

The suc­cess­ful bid­der will be required to enter into a con­tract with the Park Author­ity as spe­cified in these doc­u­ments, includ­ing The Cairngorms Nation­al Park Author­ity (Park Author­ity) con­di­tions of con­tract for the pur­chase of ser­vices (Annex II).

Oth­er Charges

Whilst every effort has been made to out­line all the require­ments of The Park Author­ity, bid­ders must ensure that their bid doc­u­ment cov­ers all the ser­vices and charges that will be applic­able for the dur­a­tion of the contract.

The fol­low­ing doc­u­ments shall form the con­tract between the Park Author­ity and the cre­at­ive prac­ti­tion­er: a) This brief and Annex I (Tender details) b) Our Terms and Con­di­tions Annex II c) The cre­at­ive practitioner’s bid received (includ­ing any cla­ri­fic­a­tions thereto).

Bid­ders shall not dis­close their bid in whole or in part to any third party without the express per­mis­sion of the Park Author­ity until after the Park Author­ity has made its final decision regard­ing the award of the contract.

All bid­ders must be inclus­ive of any and all charges likely to be incurred in the com­ple­tion of the ser­vice, includ­ing all admin­is­trat­ive costs, over­heads, trav­el­ling, expenses etc). The Park Author­ity reserves the right to cla­ri­fy any ele­ment of these costs with the suc­cess­ful bid­der pri­or to enter­ing into the con­tract of appointment.
